How to get a license to do a Fruvous song?

Discussion: How to get a license to do a Fruvous song?
Angelo Benedetto · 20 years, 4 months ago

Hi all. I'm a member of an a cappella group that is trying desperately to get the mechanical license for a Moxy Fruvous song. We are set to go to (limited) press on our CD in the next couple of weeks, and we can't get any response from the officials we've contacted about getting the mechanical license for the US.

Does anyone here have any idea how I could solve this problem?

Thanks!

The mechanical is negotiated with the copyright holder. No idea who holds the copyright to Fruvous's stuff... You might try ASCAP.

You can get a compulsory license simply by notifying the copyright owner within 30 days after the recording is made & before it is distributed. No contract needed, although the royalty fees are higher than if you negotiated a mechanical with the copyright holder.

Fruvous is Canadian, so you might want to try SOCAN instead. *dunno*

I have no idea how international mechanical licenses work. He said US distribution, so ASCAP seemed reasonable.

If you have not already done so, try The Harry Fox Agency.

Apparently, If you plan to manufacture fewer than 2500 copies of the CD, you can search their database and obtain a license via e-mail. They have 29 Moxy Fruvous songs, so the one you want to record may (or may not) be there.

Update:

In the words of our soprano, apparently she is a blonde all the way to the roots. It turns out Harry Fox *does* have Lazy Boy, and she was just missing it when she looked there.

Thanks again to all who helped with this.

Now for any of you in the Houston, TX area who might want to hear us sing this number, we'll be at Anderson Fair on May 15.

Which song do you want to record?
Angelo Benedetto Back · 20 years, 4 months ago

First of all, thanks to everyone who answered so quickly. Wow!

OK, details. We want to record Lazy Boy, which is not on the Harry Fox list. Many songs are, including the majority of the songs on our CD, but alas, not Lazy Boy.

The woman in our group who has been trying to deal with this was told by someone at Warner Music Canada that it wouldn't be a problem to get the Canadian license, but she couldn't give us the American license.

We've since contacted CMRA (which is apparently like a Canadian Harry Fox), and they say that they don't own the rights to LB, but that Fruvous Publishing does. An e-mail to them has bounced, and has been followed by a hard copy letter via snail mail, but we fear that will take far too long for us to meet our scheduled release date.

We are really trying here, but it's starting to get rather frustrating.

Thanks again for all the helpful suggestions. I'll see what else I can do on my end.

Angelo
